What types of cover are available?

The following list is not exhaustive but illustrates the range of policy types available. Each risk is underwritten according to our criteria for the type of risk and circumstances of the case:

Defective Title:

  • Adverse Possession/Possessory Title/Good Leasehold Title
  • Lost Title Deeds
  • Denial of Access/Lack of Easements
  • Outstanding Rights (of Way or otherwise)
  • Outstanding Easements
  • Flying and Creeping Freeholds
  • Chancel Repair
  • School Sites Act
  • Insolvency Act -Deeds of Gift/Transfers at Undervalue
  • Lack of planning permission and/or building regulations approval
  • Village Green

Restrictive Covenants:

  • Existing breach of restrictive covenants
  • Proposed breach of restrictive covenants where action to enforce them is considered unlikely because of the age of the covenants, or changes in the area
  • Unknown covenants
  • Breaches of some old leasehold covenants

Judicial Review:

Providing protection in respect of a specified development to allow contractual obligations to be met and/or allow work to commence in the period during which an application for a Judicial Review of the planning permission for the proposed development could be made.

Defective Leases:

The policy cover will vary according to the defect. These covers can assist in complying with various requirements listed in the CML Handbook.

Risks considered include:

  • Lack of reciprocal repairing covenants
  • Failure by landlord or other tenants to insure
  • Frustration of reinstatement following destruction.
